Privacy Policy
This policy explains how ViVi Creators collects and uses personal data when you visit vivicreators.es, request our services, apply to join our creator roster or correspond with us. We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and the Spanish Organic Law 3/2018 (LOPDGDD).

We do not use your data for automated decision-making or profiling, and we do not sell it. Our services are aimed at businesses and adult creators; we do not knowingly collect data from anyone under 18.
3. How long we keep it
- Brand requests that do not lead to a project: up to 12 months after our last contact.
- Client and invoicing data: for as long as legally required — generally 6 years under the Spanish Commercial Code and tax legislation.
- Creator applications: until you ask us to delete them or withdraw consent, and in any case no longer than 24 months without contact.
- Business contacts: until you object, or 12 months without a reply.
4. Who we share it with
We do not share your data with third parties except the service providers that help us run ViVi Creators, acting on our behalf under data processing terms:

With your agreement, creators' profiles (first name, city and work samples) may be shared with a client brand for a specific project. Our tax advisor may access invoicing data to meet our legal obligations, and we may disclose data to public authorities when required by law.
International transfers. Some providers are based in, or may access data from, the United States. In those cases transfers rely on appropriate safeguards, such as the EU–US Data Privacy Framework where the provider is certified, or the European Commission's Standard Contractual Clauses.
5. Your rights
You can ask us at any time to access, correct or delete your data, to restrict or object to its processing, or to receive it in a portable format. Where processing is based on consent, you can withdraw it at any time without affecting earlier processing. Write to hola@vivicreators.es; we will reply within one month.
If you believe we have not handled your data correctly, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) or the authority in your country.
6. Security
We use reputable providers, encrypted connections (HTTPS), two-factor authentication on our accounts and access limited to what is needed to run the service.

This site does not use advertising or analytics cookies. See our Cookie notice.
8. Changes
We may update this policy when our services or providers change. The date at the top shows the latest version.

Esta política explica cómo ViVi Creators trata los datos personales cuando visita vivicreators.es, solicita nuestros servicios, se postula como creador/a o se comunica con nosotros, conforme al Reglamento General de Protección de Datos (RGPD) y la Ley Orgánica 3/2018 (LOPDGDD).

2. Datos, finalidades y bases legales
- Marcas (formulario de solicitud): nombre, email profesional, web, producto, paquete y mercado, notas. Finalidad: responder y preparar una propuesta. Base: medidas precontractuales y ejecución del contrato (art. 6.1.b RGPD).
- Clientes: datos de contacto y facturación, brief y comunicaciones. Finalidad: prestar el servicio, facturación y contabilidad. Base: contrato (6.1.b) y obligaciones legales fiscales y mercantiles (6.1.c).
- Creadores (formulario en Tally): nombre, email, WhatsApp, ciudad, idiomas, nichos, mascotas, enlaces a trabajos y perfiles, tarifa, experiencia, notas. Finalidad: valorar tu perfil y contactarte para proyectos remunerados. Base: tu consentimiento (6.1.a), que puedes retirar en cualquier momento.
- Contactos profesionales: nombre, email profesional, empresa y cargo obtenidos de fuentes profesionales públicas. Finalidad: enviar un número limitado de comunicaciones profesionales sobre nuestros servicios. Base: interés legítimo (6.1.f); puedes oponerte en cualquier momento.
- Correos que nos envías: dirección y contenido. Finalidad: responder. Base: interés legítimo (6.1.f) o medidas precontractuales.
- Visitantes: datos técnicos (IP, navegador) tratados por el proveedor de alojamiento. Finalidad: seguridad y funcionamiento del sitio. Base: interés legítimo (6.1.f).
No tomamos decisiones automatizadas ni vendemos datos. No recogemos conscientemente datos de menores de 18 años.
3. Conservación
Solicitudes sin proyecto: hasta 12 meses. Datos de clientes y facturación: el plazo legal (en general, 6 años). Candidaturas de creadores: hasta que solicites su supresión o retires el consentimiento, y como máximo 24 meses sin contacto. Contactos profesionales: hasta tu oposición o 12 meses sin respuesta.
4. Destinatarios y transferencias
Solo compartimos datos con los proveedores que nos prestan servicio como encargados del tratamiento: Cloudflare (alojamiento y seguridad, EE. UU.), Formspree (formulario de marcas, EE. UU.), Tally (formulario de creadores, Bélgica), Google (hoja de cálculo, UE/EE. UU.) y Zoho (correo, centro de datos en la UE). Con tu acuerdo, el perfil de un creador (nombre, ciudad y ejemplos de trabajo) puede compartirse con una marca cliente para un proyecto concreto. Nuestro asesor fiscal puede acceder a los datos de facturación, y podremos comunicar datos a las autoridades cuando la ley lo exija. Las transferencias a EE. UU. se amparan en garantías adecuadas, como el Marco de Privacidad de Datos UE-EE. UU. o las Cláusulas Contractuales Tipo de la Comisión Europea.
5. Tus derechos
Puedes ejercer los derechos de acceso, rectificación, supresión, limitación, oposición y portabilidad, así como retirar tu consentimiento, escribiendo a hola@vivicreators.es. Responderemos en el plazo de un mes. También puedes presentar una reclamación ante la Agencia Española de Protección de Datos (www.aepd.es).
